PHIN’s Compliance Report is used to assess whether organisations who provide private in-patient or day-case healthcare in the UK are meeting their obligations under the CMA Private Healthcare Market Investigation Order 2014.
What the PHIN compliance report measures
The Order mandates the submission of sufficient quantity and quality of data, enabling PHIN to publish accurate and meaningful data about the sector to inform patient choice and encourage competition in the market.
This report shows providers’ progress in submitting data at individual site level. It also highlights areas where data may be incomplete, or lack the necessary detail, to meet the standards required for PHIN to be able to publish key measures. These are measured against six milestones:
- Milestone 1 (Volume): Sufficient 12 months admitted patient care (APC) data or null returns for their sites.
- Milestone 2 (Length of Stay): Sufficient 12 months APC data with procedure codes (OPER01 & DIAG01) or null returns for their sites.
- Milestone 3 (Adverse Events): Sufficient APC data and linked Adverse Event data for their sites.
- Milestone 4 (Patient Feedback): Sufficient Patient Satisfaction and Experience data for their sites or have provided a complete 36 months of null returns for the publication period.
- Milestone 5 (Patient Reported Outcome Measures): Sufficient PROMs data (where eligible) for their sites or have provided a complete 12 months of null returns for the publication period.
- Milestone 6 (Clinical coding): Sufficient data with clinical diagnosis code and clinical operation code.
Data Maturity (Milestone 7)
In our ongoing effort to enhance the visibility of data quality across the private healthcare sector, we have introduced an additional step beyond CMA Compliance, milestone 7 to PHIN’s Data Maturity framework.
- Milestone 7 (Data Maturity): Sufficient data for NHS Number, Gender, Postcode, Age and Discharge Method.
This milestone is specifically designed to monitor the data quality required for ‘Linked Measures,’ These measures are crucial for providing a comprehensive view of patient outcomes and the quality of care provided across the sector.

Note on compliance levels
There is a time lag between collecting, validating and processing the data we receive from hospitals before we publish it on the website. This can be up to 6 months after treatment has been completed, to ensure a fair process and accurate data.
Most hospitals submit data on a cyclical basis, therefore low levels of data in the 'Next' Publication Period do not necessarily mean that they are not complying with their requirements. Please refer to the ‘Current’ Publication Period, to see compliance levels at the end of the cycle.
